Preparation of Last Will & Testament

The preparation of the last will and testament entails the writing of a valid will disposing of one’s possessions at the time of death. If this is not done, one’s material possessions will pass according to Pennsylvania’s intestacy statute. It should be noted that in Pennsylvania, while one’s children can be written out of a will, one cannot write their spouse out of a will for less than one-third (1/3) of their total property at death, unless a valid prenuptial agreement exists waiving the spouse’s statutory share.
